What is Cerebral Palsy?

Thomas M. Kiley and Associates, LLP

Cerebral palsy is basically damage to the brain through trauma. It has many potential causes. Some are not preventable, some are. The ones that are preventable typically involve the treatment that's rendered to the mother and the child during the birth process. Leaving the child in the birth canal too long, a forceps delivery, vacuum extraction. Perhaps the failure to perform a cesarean section when the child is too large to pass through the birth canal. I'm Attorney Tom Kiley. I've been representing the seriously injured and their families in Massachusetts for over three decades.

When is Cerebral Palsy typically diagnosed?

Thomas M. Kiley and Associates, LLP

Tom Kiley: Cerebral Palsy typically is not diagnosed until the child is two, perhaps three years of age. What happens is the parents notice that the child is not reaching its normal milestones. It can't roll over on its own. It can't crawl. It can't walk. At that point the child needs to have medical evaluation to determine what the condition is. Parents don't always understand that there was trauma during the birth process that may have injured their child. After they see a doctor and find out, they need to see an attorny who's experienced in the area. I'm attorny Tom Kiley. I've been representing the seriously injured and their families in Massachusetts for over three decades.

What is the cause of Cerebral Palsy?

Steven E. North

Cerebral palsy is the result of lack of oxygen to the brain. When it happens in childbirth or in the neo-natal period, it's often a result of the fetal heart rate dropping significantly and thereby producing less oxygen in the blood getting to the brain. If that persists, then brain damage will occur. If the hospital doctors and nurses see that it's happening by examining the fetal monitoring strips, it requires immediate Cesarian section to protect that fetus. I'm Steven North; I specialize in medical malpractice litigation; my office is located in a townhouse in the upper east side of Manhattan; we welcome your call.

Can birth injuries be prevented?

Thomas M. Kiley and Associates, LLP

Many birth injuries can be prevented. And it goes directly to the level of care that's provided by our physicians and our hospitals, Many times doctors, or people that are in charge of the pre-natal care, for a mother who's expecting a child don't do what they're supposed to do. They don't monitor the mother's blood sugar. They don't determine whether she's diabetic and going to have a large baby that won't fit through the birth canal. These are very important things that have to be done. If a baby's too large and can't fit through the birth canal and a cesarean section is not performed, it's a formula for disaster. And they're starting to question what's wrong with the child because they don't necessarily understand that something traumatic happened during the birth process.
